Cooper & Scully Attorneys Obtain Victory in High-Stakes Patent Litigation

DALLAS - The Cooper & Scully trial team recently won summary judgment in favor of multiple energy firms in a patent litigation matter, Red Dog Mobile Shelters, LLC v. Kat Indus., et al., 2015 WL 5896124 (N.D. Tex. October 6, 2015) (Kinkeade, J.). The lawsuit was filed in 2013 by a storm shelter company, seeking over $20MM in alleged damages from two energy firms operating across the United States.

The energy firms retained Cooper & Scully, P.C. to defend them in the litigation. Cooper & Scully assembled its trial team, asserting that the storm shelter company’s patent was neither valid nor infringed. The trial team proceeded through discovery and the Court’s Markman ruling, and moved for summary judgment on July, 29, 2015. In a twelve page opinion, the Court granted summary judgment in the trial team’s favor and entirely disposed of the plaintiff’s patent infringement case. The Court ruled that the plaintiff’s infringement allegations lacked sufficient evidence and failed as a matter of law.
