Join us on Wednesday, June 23, 2010 for a discussion on the recent decision of the Texas Supreme Court in Gilbert Texas Construction v Underwriters at Lloyds. Mr. Cooper will examine the contractual liability exclusion from a historical perspective and drafting intent and how the exclusion was interpreted by the court in the present case. He will examine whether the decision conflicts with Lamar Homes v Mid-Continent Insurance. Finally, the issue of whether the case changes well established Texas law on waiver and estoppel will be examined.
