Join us on Wednesday, January 27, 2010 for a discussion on the Texas Supreme Court's holding in D.R. Horton – Texas, Ltd. v. Markel International Insurance Company, Ltd. that the duty to indemnify is not dependent on the duty to defend. An insurer may have a duty to indemnify its insured even if the duty to defend never arises. In addition, he will discuss the rationale for the holding and the impact of the case from the standpoint of the insured and insurer.
