This discussion will focus on the recent trends in mega verdicts, some of the reasons they are happening, and some of the tactics that the plaintiffs’ bar is using to obtain these very large verdicts. Also discussed will be some ways that the defendants can combat these tactics and strategies that can be employed to try to help juries reduce the verdicts to numbers supported by evidence. These tactics may lead to defense verdicts, but they may also introduce ideas that, if employed, may help hold plaintiff’s verdicts to realistic values.
