Join us on Wednesday, June 24, 2009 at 12:00 p.m. for a one hour webinar to discuss the June 5, 2009 decision by the Supreme Court regarding an issue that had been long debated among legal scholars and judges: "Does the defense have the right to ex parte communications with the Plaintiff's treating physicians?" Texas state and federal courts had been divided on the subject. Courts in other states, likewise, were not in agreement.
The speakers will address the background of the case, the holding by the Texas Supreme Court, and how far the holding extends. The webinar will also focus on potential situations where the courts may allow restrictions in ex parte contacts and what remedies may be available for violations of HIPPA or the privileges that exist between the physician and the patient.
