DALLAS - Attorneys R. Brent Cooper, Gordon Wright and Micah Dortch of Cooper & Scully, P.C. obtained a defense verdict on behalf of Antares Homes, Ltd., Antares Homes, L.L.C., Antares, G.P., L.L.P., and Ronald F. Formby, in a copyright infringement case case in Fort Worth, Texas. The plaintiff, KB Home, filed suit in 2004 alleging Antares Homes copied four of its production housing floor plans and sold the homes throughout the Fort Worth area. KB Home sought Antares' profits from the sale of the alleged infringing plans as damages. Antares defended the claims by demonstrating the plans at issue were not probatively similar and Antares did not have access to at least one of the Plaintiff's copyrighted plans. The jury rendered a unanimous defense verdict.
